These Terms of Service ("Terms") govern your access to and use of MailFleet desktop email campaign software, the mailfleet.app website, documentation, free tools, licensing services, and support channels operated by Secuno LLC ("MailFleet," "we," "us," "our"). By purchasing, installing, or using MailFleet, you agree to these Terms.

Agreement to these Terms
These Terms form a binding agreement between you and Secuno LLC when you access mailfleet.app, purchase a MailFleet license, download installers, activate software, or use support channels. If you use MailFleet on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, do not purchase, install, or use MailFleet. Your continued use after we post updated Terms constitutes acceptance of the revised Terms where permitted by law.
These Terms incorporate by reference the Acceptable Use Policy, Anti-Spam Policy, and Privacy Policy. In the event of conflict between marketing copy and these published legal documents, the legal documents control for rights and obligations.

Scope of services
MailFleet provides desktop email campaign control software that helps operators manage templates, SMTP and API provider profiles, proxy routing, SpamAssassin checks, sending capacity scoring, webhooks, campaign logs, and reports. The software connects to email infrastructure you configure; MailFleet does not send mail through a shared proprietary SMTP pool.
We also provide the mailfleet.app website, documentation, free diagnostic tools, license validation, and customer support as described on the site and in your plan. Features may evolve over time. We may add, modify, or discontinue non-core features with reasonable notice when practicable.
MailFleet is professional software for permission-based campaigns. It is not legal advice, deliverability consulting, or a substitute for compliance counsel. You remain responsible for lawful sending practices.
Eligibility and accounts
You must be at least 18 years old — or the age of majority in your jurisdiction — to purchase or use MailFleet under these Terms. You must provide accurate information during purchase and support interactions.
License keys and activation credentials are personal to your organization unless an enterprise agreement expressly permits broader deployment. You are responsible for safeguarding license credentials and for all activity under licenses you control.
We may refuse service, decline sales, or limit quantities when we suspect fraud, resale abuse, or policy risk.
Software license grant
Subject to these Terms and payment of applicable fees, Secuno LLC grants you a limited, non-exclusive, non-transferable, revocable license to install and use the MailFleet desktop application on devices you own or control, solely for your internal business purposes or client work where you have compliance authority.
This is a license grant — not a sale of software ownership. No rights are granted except as expressly stated. Enterprise or volume agreements may provide additional rights in writing.
Open-source components included in MailFleet remain subject to their respective licenses, which are available upon request or in product documentation where applicable.

License plans and entitlements
MailFleet currently offers a 1 Year License and a Lifetime License as described on the pricing page. Plan names, prices, and included entitlements may change for future purchases; your active plan is governed by the terms presented at checkout unless we agree otherwise in writing.
The 1 Year License provides access to MailFleet desktop software and included updates for one year from purchase, renewable per then-current pricing. The Lifetime License provides ongoing access to MailFleet with minor updates included; major version upgrades may be offered separately in the future, as stated on the pricing page.
Standard MailFleet pricing does not include per-contact, per-campaign, or per-email software fees. Provider costs from SMTP or API vendors are separate and billed by those third parties.

License restrictions
You may not copy, modify, adapt, translate, or create derivative works of MailFleet except as permitted by law or written agreement. You may not reverse engineer, decompile, or disassemble the software except to the limited extent expressly allowed by applicable law.
You may not remove proprietary notices, circumvent license validation, use MailFleet to build a competing product through unauthorized extraction of logic or assets, or use the software in violation of export control or sanctions laws.
You may not use MailFleet for any purpose prohibited by the Acceptable Use Policy, including spam, phishing, malware distribution, list harvesting, harassment, or deceptive sending practices.
Acceptable Use, Anti-Spam, and Privacy
Your use of MailFleet is subject to the Acceptable Use Policy and Anti-Spam Policy published on mailfleet.app. Those policies describe permitted conduct, prohibited activities, provider rules, proxy standards, consent expectations, and enforcement procedures.
The Privacy Policy explains how we handle website, support, licensing, and related data. Campaign lists, templates, and logs are stored locally on your devices by default; you are responsible for securing that data and complying with privacy laws applicable to your recipients.
Violation of incorporated policies is a material breach of these Terms and may result in suspension or termination without refund where permitted by law.
Payment, billing, and taxes
Fees are due at the time of purchase unless we agree to invoicing in writing for enterprise deals. Prices are shown in US dollars unless another currency is explicitly offered at checkout. Payment processing may be handled by third-party processors; their terms apply to payment transactions.
You authorize us and our processors to charge the payment method you provide for applicable fees, renewals (if you enroll in renewal where offered), and agreed add-ons. You are responsible for accurate billing information and for all taxes, duties, or government charges associated with your purchase except taxes based on our net income.
If a charge fails, we may suspend license validation until payment is resolved. We are not responsible for bank fees, currency conversion charges, or processor declines outside our control.
Refunds and money-back guarantee
Unless otherwise stated at checkout or required by applicable consumer law, license fees are non-refundable once a license key is delivered and activation succeeds.
New license purchases may qualify for a 14-day money-back guarantee when explicitly stated on the pricing page, checkout flow, or order confirmation. Refund requests must be submitted within that period through our contact channels with sufficient information to locate your order.
Refunds do not apply to renewals, abuse-related terminations, chargeback fraud, or situations where you materially breached these Terms. Regional consumer rights may provide additional remedies that these Terms do not limit.

Updates, support, and availability

Support is provided through published channels (contact form, email) during the support period associated with your plan. Support covers MailFleet software operation — not third-party provider outages, DNS misconfiguration at your registrar, or legal compliance consulting.
We strive for reliable licensing and website availability but do not guarantee uninterrupted access. Scheduled maintenance, provider outages, and force majeure events may cause temporary unavailability.
Third-party SMTP, API, and infrastructure
MailFleet connects to SMTP relays, HTTP APIs, proxies, and other services you configure. We do not control and are not responsible for third-party providers, their pricing, deliverability, rate limits, suspensions, or terms of use.
Your relationship with email providers is direct. Provider acceptable use policies, authentication requirements, and billing apply independently of MailFleet. Downtime or blocking by a provider is not a MailFleet warranty event.
Integrations and webhooks may interact with systems you operate. You are responsible for securing endpoints, validating payloads, and ensuring automations do not cause harmful or unlawful sending behavior.
Your data and responsibilities
You retain ownership of campaign content, lists, templates, logs, and configuration data you create in MailFleet, subject to third-party rights in underlying materials. MailFleet does not claim ownership of your recipient lists or message bodies stored locally on your devices.
You grant us a limited license to process information you submit through support, contact forms, or license validation solely to operate services, prevent fraud, enforce policies, and improve products.
You are responsible for backups, workstation security, access controls, and lawful processing of personal data in your lists. See the Privacy Policy and Security documentation for architecture details.
Intellectual property
MailFleet, the mailfleet.app website, trademarks, logos, documentation, and underlying software are owned by Secuno LLC or its licensors and protected by intellectual property laws. These Terms do not grant you any rights in our branding except limited use necessary to operate licensed software.
Feedback, suggestions, or ideas you provide may be used by us without obligation or compensation, except where prohibited by law.
If you believe content on mailfleet.app infringes your rights, contact us with a detailed notice including identification of the work, location of the material, and your contact information.
Disclaimers
MAILFLEET AND RELATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that MailFleet will be error-free, uninterrupted, or free of harmful components. We do not guarantee email deliverability, inbox placement, open rates, revenue outcomes, or provider acceptance of your campaigns.
Free tools and documentation are provided for informational and preparatory purposes. Results may vary based on DNS propagation, provider behavior, and list quality.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SECUNO LLC AND ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR REPUTATIONAL HARM, ARISING FROM OR RELATED TO THESE TERMS OR MAILFLEET, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL AGGREGATE LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR MAILFLEET WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR MAILFLEET IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.
Indemnification
You will defend, indemnify, and hold harmless Secuno LLC and its officers, directors, members, employees, and agents from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of MailFleet; (b) your campaigns, lists, or content; (c) your violation of these Terms or incorporated policies; (d) your violation of law or third-party rights; or (e) dispute between you and your clients or providers related to sending practices.
We may assume exclusive defense of matters subject to indemnification at your expense if we choose. You will cooperate with our defense efforts.
Suspension and termination
You may stop using MailFleet at any time. Annual licenses expire at the end of the licensed term unless renewed. Lifetime licenses continue subject to these Terms until terminated.
We may suspend or terminate your license immediately for material breach, Acceptable Use or Anti-Spam violations, non-payment, fraud, chargeback abuse, or legal requirement. Where practicable, we may provide notice and an opportunity to cure non-abuse breaches.
Upon termination, your license ends and you must cease use of MailFleet except as required by law. Sections that by nature should survive (payment obligations, disclaimers, liability limits, indemnity, governing law) survive termination.
Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence provide otherwise.
Before filing a claim, you agree to contact us at the email below and attempt good-faith resolution. If informal resolution fails, disputes will be brought in the state or federal courts located in Wyoming, and you consent to personal jurisdiction there, unless applicable law requires a different forum.
Nothing in these Terms limits either party's right to seek injunctive relief for intellectual property misuse or policy violations.
Changes to these Terms
We may update these Terms to reflect product changes, billing practices, legal requirements, or enforcement experience. Updated Terms will be posted on this page with a revised modification date. Material changes may also be communicated through reasonable channels when appropriate.
If you disagree with updated Terms, you must stop using MailFleet and may request applicable remedies under refund or consumer laws. Continued use after the effective date constitutes acceptance where permitted.
Miscellaneous
These Terms, together with incorporated policies and plan-specific checkout terms, constitute the entire agreement regarding MailFleet unless superseded by a signed enterprise agreement.
If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with merger, acquisition, or asset sale.
No agency, partnership, or joint venture is created by these Terms. MailFleet is not responsible for failures caused by events beyond our reasonable control, including internet outages, provider failures, natural disasters, or government actions.
